REST YOUR CAR
OFFICIAL RULES
1. Eligibility. The Rest Your Car program is open to all Des Moines area commuters, 18 years of age or older. “Commuter” refers to any person, 18 years of age or older, who is traveling to and from work. Employees of the Greater Des Moines Partnership, Downtown Community Alliance, Downtown Events Group, Diligent Information Services and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies and other agents, and the immediate family members of and any persons domiciled with such employees or agents, are not eligible.
2. Entry. To participate, visit www.drivetimedesmoines.org and enroll in the Rest Your Car program, or visit the Transportation Management Association (TMA) offices (700 Locust St., Ste. 100, Des Moines, IA) during regular business hours, and complete a registration form.
· You must be enrolled in the Rest Your Car program to be eligible for monthly and quarterly prize drawings.
· You must use and record your use of an alternate commute option (carpool, vanpool, ride the bus, telecommute, bike or walk) at least four (4) times a month to be eligible for the monthly prize drawings. This use of a commute option must be recorded online at http://www.drivetimedesmoines.org.
· You must use and record your use of an alternate commute option (carpool, vanpool, ride the bus, telecommute, bike or walk) at least four (4) times a month for the three months making up the quarter to be eligible for the quarterly prize drawing. The quarters are made up of the following months:
First Quarter: January, February, March
Second Quarter: April, May, June
Third Quarter: July, August, September
Fourth Quarter: October, November, December
· Participants’ use of a commute option must be recorded online at http://www.drivetimedesmoines.org. If you do not have access to a computer, but would like to participate in the Rest Your Car program, please contact the TMA at 515-286-4969
· Participants who fraudulently record their use of an alternate commute option will be disqualified and forfeit all claims to the prize, and the prize will be awarded to an alternate winner.
3. Drawings and Prizes. Monthly drawings will be held for prizes as determined by Organizer. Grand Prize winners will be selected each quarter. The quarters are made up of the following months:
First Quarter: January, February, March
Second Quarter: April, May, June
Third Quarter: July, August, September
Fourth Quarter: October, November, December
All prizes, including but not limited to, the quarterly grand prize(s) are to be determined by the Organizer and are subject to change without notice. Odds of winning depend on the number of eligible participants.
4. Notification and Acceptance. Monthly winners will be notified by telephone and/or U.S. Mail and/or e-mail correspondence and/or by their employer by the 15th of the following month. For example, participants who were eligible for prizes in April will be notified by May 15. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Quarterly winners will be notified by telephone and/or email correspondence in order to make arrangements for delivery of the prize. The quarterly prizes will also be awarded by the 15th of the month following the quarter. For example, participants who are eligible for prizes in the first quarter will be notified by April 15. If the TMA is unable to reach the winner via telephone or email and/or the winner does not responded to emails and/or voicemails, the winner will be notified via Certified Mail through the U. S. Postal Service. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. If the TMA has not received a response within two (2) weeks of the postmarked date of the Certified Mail a new winner may be chosen. The TMA is not is not responsible for items lost and/or not delivered by the U.S. Postal Service. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No susbstitutions allowed, except that prizes and individual components of prize packages are subject to availability and Organizer reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of taxes on prizes. Participants who fraudulently record their use of an alternate commute option will be disqualified and forfeit all claims to the prize, and the prize will be awarded to an alternate winner. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release at the time they receive their prize. Failure to sign and return the affidavit or release or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Except where prohibited, participation in the program constitutes participant’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. 5. Participation. By participating, participants agree to be bound by these Official Rules and the decisions of the Organizer. Organizer reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this drawing as solely determined by the Organizer. In the event the drawing is compromised by a virus, non-authorized human intervention or tampering or other causes beyond the reasonable control of the Organizer which corrupts or impairs the administration, security, fairness or proper operation of the drawing, Organizer reserves the right in its sole discretion to suspend, modify or terminate the drawing. Should the drawing be terminated prior to the stated drawing date, Organizer reserves the right to award prizes based on the entries received before the termination date.
6. Limitations of Liability. By entering the program, participants agree that (1) any and all disputes, claims and causes of action arising out of or in connection with the drawing, or any prizes awarded, shall be resolved informally without resort to any formal claims, causes of action or dispute resolution proceedings; (2) any claims shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the drawing, but in no event attorney’s fees; and (3) under no circumstances will any participant be permitted to obtain any award for and participant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
7. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and Organizer, shall be governed by and construed in accordance with the laws of the State of Iowa, without giving effect to any choice of law or conflict of law rules or provisions. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein.
8. General Release. By registering for the program, participants release The Greater Des Moines Partnership, Downtown Community Alliance, Downtown Events Group, and any other services providers and/or promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with any drawing or with the acceptance, possession of use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light.)
9. Organizer. The Rest Your Car program is organized by the Transportation Management Association in cooperation with the Downtown Community Alliance (collectively, the “Organizer”) whose decisions regarding the selection of winners and all other aspects of any drawing or any prize shall be final and binding in all respects. Organizer will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to any drawing or prize.
